1. The Contracting Authority shall remove from participation in the procedure a participant for which there is any of the circumstances under Art. 54, para. 1, Art. 55, para. 1, items 1, 3, 4, 5 and Art. 107 of the PPA, in the presence of connectivity within the meaning of - 2,item 45 of the SG of the Public Procurement Act between the participants in the procedure, in the presence of a circumstance under Art. 3, item 8 of the Economic and Financial Relations Act with the companies registered in preferential tax jurisdictions, the persons controlled by them and their actual owners, in the circumstances under Art. 69 of the Law on Counteracting Corruption and for Removal of the Unlawfully Acquired Propertyas well as a participant who does not meet the selection criteria set or fails to fulfill another condition and / or requirement specified in the contract notice or in the documentation or who has submitted a tender which does not correspond to the terms and conditions previously announced in the contract; in any way has included somewhere in his offer outside the envelope "Offered Price Parameters" items relatedand the offered price and / or parts thereof. The Contracting Authority will remove from participation in the procedure the participant whose proposal for fulfillment of the contract does not fulfill all the conditions of the technical specification, has not submitted the justification under Art. 72, para. 1 of the Public Procurement Act or its offer has not been accepted according to Art. 72, para. 3-5 of the Public Procurement Act, as well as when it has indicated in its price proposal a total value excluding VATto execute the order that exceeds the total estimated value, or has made an arithmetical error in the bid. Where a participant in a procedure is a grouping which is not a legal person, a copy of the document shall be required showing the legal basis for the formation of the grouping, as well as the rights and obligations of the group members, the distribution of liabilityamong the members of the grouping, the activities that each member of the grouping will carry out in connection with this contract. The guarantee for the performance of the public procurement contract is 5% (five per cent) of its value excluding VAT. The assignor determines that 20% of the amount of the performance guarantee is intended to provide warranty maintenance. Terms and conditions forholding and release of the performance guarantee are specified in the draft contract for public procurement
